Reclassification to Florida Resident

Residency Status Appeal Form

*The decision is Ruiz, et al. v. Gerard Robinson, et al., Case No. 11-cv-23776-KMM, the United States District Court for the Southern District of Florida.

November 13, 2012

A federal court in Florida has determined that U.S. citizen students who have been classified as non-residents for tuition purposes based upon their parents’ immigration status or failure to document their parents’ legal presence in the United States may be eligible for in-state tuition provided they, and their parents if the students are dependent on their parents, can meet the requirements of Florida’s residency law.  As a result of the court decision, information on the immigration status of the parents of U.S. citizen students cannot be requested when making residency determinations.

The court has not changed the other requirements that dependent students must meet to demonstrate Florida residency for tuition purposes.  For such students, Florida law generally requires evidence of a parent’s actual residency in Florida.  Follow this link for the residency for tuition information: www.scf.edu/residency.

If you are a U.S. citizen and have been classified as a non-Florida resident for tuition purposes, and you believe you have been classified as such due to your parents’ immigration status in the U.S.  or due to your failure or inability to document your parents’ legal presence in the United States, please contact Karen Armstrong or Stacey Sharples at State College of Florida not later than the first day of Spring Term 2013, January 7, 2013, to request a review of your tuition classification for Spring Term 2013.
